www.datalive.in, (hereinafter referred to as "DL") is owned, hosted and operated by RVG Newsvision Private Limited (hereinafter referred to as "RVG"), a company incorporated in India under the Companies Act, 1956.
Ownership of the database of DL is vested exclusively with RVG. Rights of access and usage are subject to the compliance with the terms and conditions set forth below.

Amendments |

RVG may amend/modify these Terms and Conditions at any time, and such modifications shall be effective immediately upon posting of the modified Terms and Conditions on DL. You may review the modified Terms and Conditions periodically to be aware of such modifications and your continued access or use of DL, shall be deemed conclusive proof of your acceptance of these Terms and Conditions, as amended/modified from time to time. RVG may also suspend the operation DL for support or technical upgradation, maintenance work, in order to update the content or for any other reason.
In a case of use of DL in a manner inconsistent with these Terms and Conditions, RVG may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper. |

Definitions |
|
| |
The term "misuse" shall mean and include all acts which are aimed at utilizing the database of DL for any purposes other than for searching and mining retail data for normal business purposes. It shall also extend to the use of the database for commercial purposes without the express permission of RVG.
The term "offensive material" shall mean and include obscene material as defined in Section 67 of the Information Technology Act of India, 2000. It shall include content which is aimed at demeaning a particular class of individuals, corporate body, country etc. It shall also include content having the effect of violating the Intellectual Property Rights of others.
The terms "service" or "services" would mean and include the online information service offered by DL on the internet through which the user may access information carried by DL in the database maintained by it. The terms would include the search tools through which the user can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. Users then select one or more of the items presented to view the full document/ record. The term service does not extend to DL acting as an agent/consultant either express or implied on behalf of any user/customer
The term "Spamming" shall mean and include any unsolicited bulk e-mails/messages or unsolicited commercial e-mails/messages.
The term "subscriber" would include any person, whether an individual or a legal entity who has subscribed to the services of DL, and to whom the access is restricted by the use of a sign in user name and a password. The user name and password are either allotted by DL or chosen by the user or agreed upon by DL.
The term "unauthorised user" is defined as any person who does not have a legal or a contractual right to access the services of DL, but does so.
The terms "User" and "customer" would include both the authorised and unauthorised user(s) |

Payments for the services offered by DL shall be on a 100% advance basis. |

Credit Card Information |

RVG does not store or keep credit card data. This is handled and kept by RVG’s secure payment partners. RVG uses the maximum care as is possible to ensure that all or any data / information in respect of electronic transfer of money does not fall in the wrong hands.
RVG shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise. |

Due to a high incidence of credit card fraud, your DL services purchased online using a credit card may not be activated without a proper verification. |

Restriction / Prohibitions |

You hereby expressly agree not to :

Use of the services of DL in a manner contrary to any law which might be applicable at the relevant time.

Access data not intended for you or log into server or account that you are not authorized to access;

Attempt to probe, scan or test the vulnerability of a system or network;

Attempt or breach security or authentication measures without proper authorization;

Attempt to interfere with, access by any other user including but not limited to by submitting a virus of any kind or Trojan horse to DL, overloading, Flooding, mail bombing or crashing;

Copy, distribute, download, display, perform, reproduce, modify, edit, alter, enhance, broadcast or tamper with in any way or otherwise use any material contained in DL except as permitted;

Copy and distribute this information on any other server, or modify or re-use information, text, graphics, sound, etc. on this Website to any other system. No reproduction of any part of the Website may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or Website, whether in hard copy or electronic format, including postings to any other Website; or

Remove any copyright, trade mark or other intellectual property notices contained in the original material from any material copied or printed off from DL or link to DL, without our express written consent.

Providing deeplinks into DL without prior permission of RVG is prohibited. Extracting data from DL using any automated process such as spiders, crawlers etc. or through any manual process for a purpose which has not been authorised in writing.

Upload, post, email, transmit or otherwise make available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail .

Posting/uploading of offensive material on DL is strictly prohibited.

Subscribers shall under no circumstance sublicense, assign, or transfer the License, and any attempt at such sublicense, assignment or transfer is void.

Post Wrong/false/misleading information on DL.

RVG reserves the right to filter and monitor and block the emails sent by you/user using the servers owned/maintained by RVG to relay emails. All attempts shall be made by RVG and the user to abide by International Best Practices in containing and eliminating Spam.
Violations of system or network security may result in civil or criminal liability. |

You agree to defend, indemnify, and hold harmless, RVG and/ or its associates, subsidiaries, their officers, directors, employees, affiliates, licensees, business partners and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of DL material or your breach of these Terms and Conditions |

Governing Law and Jurisdiction |

Courts at New Delhi , India alone shall have the exclusive jurisdiction in all matters relating to DL and these Terms and Conditions, irrespective of the territory and jurisdiction of your access to DL.
RVG reserves its rights to monitor all activities related to the DL. However, if RVG becomes aware of an inappropriate use of DL or any of its Services, RVG will respond in any way that, in its sole discretion, RVG deems appropriate. You acknowledge that RVG will have the right to report to law enforcement authorities any actions that may be considered illegal, as well as any information it receives of such illegal conduct. When requested, RVG will co-operate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.
RVG reserves all other rights.

RVG agrees to provide the service to the subscriber only for the duration contracted for to the best of its ability
- RVG reserves its right to suspend/terminate the services contracted for by the subscriber either prior to or during the contracted period without assigning any reason. In such an eventuality, any amount so paid for by the subscriber for this service, may be refunded by RVG at a prorata basis to the subscriber at its discretion.
- The subscriber shall be entitled to one user names / passwords to access the service and additional user names / passwords may be provided by RVG on such terms and conditions as may be mutually agreed upon.
- RVG would not be held liable for any loss of data technical or otherwise, information due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond RVG's reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities
- RVG will commence providing services only upon receipt of amount/charges upfront either from the subscriber or from a third party on behalf of the subscriber
- RVG reserves its right to change the look, feel, design, prominence, depiction, classification of any section of DL at any time without assigning any reason and without giving any notice
- This subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual concern.
- This subscription shall entitle the subscriber alone to the use and access of DL. Continuous usage of the same from third party premises including any affiliates etc of the subscriber shall amount to illegal usage, which shall entitle RVG to discontinue services without refund/notice.
- The subscriber shall be assigned a password (s) by RVG to enable the subscriber to access all the information received through the software, but the sole responsibility of the safe custody of the password shall be that of the subscriber and RVG shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. RVG undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber
- The information on RVG is for use by its subscribers alone and does not authorize the subscriber to download and use the data for commercial purposes. In case any one is found to be in violation of this then RVG at its discretion may suspend its service/subscription and also may take such action as it may be advised.
- All disputes arising out of the transactions between a user and RVG will be resolved in accordance with the laws of India as applicable.
- All Disputes arising out of the transactions between a user and IEIL will be subject to the excusive jurisdiction of Courts situate in Delhi .
